3.1 Booking Process

By making a booking, you:

  • Accept responsibility for all travelers in your booking
  • Confirm all information provided is accurate

3.2 Pricing

All prices are quoted in US Dollars unless otherwise stated. Prices are subject to change until booking is confirmed. We reserve the right to correct pricing errors.

3.3 Payment

We accept payment by:

  • Mobile money (M-Pesa)

4. Your Responsibilities

You are responsible for:

  • Ensuring valid travel documents (passport, visas)
  • Obtaining required vaccinations
  • Purchasing adequate travel insurance
  • Meeting fitness requirements for activities
  • Disclosing relevant medical conditions
  • Following safety instructions during the safari
  • Respecting local laws, customs, and wildlife

5. Our Responsibilities

6. Limitation of Liability

6.1 We Are Not Liable For:

  • Loss, injury, or damage arising from circumstances beyond our control
  • Actions or omissions of third-party service providers
  • Your failure to follow instructions or meet requirements
  • Wildlife behavior or natural events
  • Indirect or consequential losses

6.2 Maximum Liability

Our total liability for any claim shall not exceed the amount paid by you for the services in question.

7. Force Majeure

8. Complaints & Disputes

8.1 During Your Trip

If you experience any issues during your safari, please inform your guide immediately so we can attempt to resolve them on the spot.

8.2 After Your Trip

Written complaints must be submitted within 28 days of your return. We will acknowledge receipt within 7 days and provide a full response within 28 days.

8.3 Dispute Resolution

We aim to resolve disputes amicably. If a resolution cannot be reached, disputes will be subject to arbitration in Nairobi, Kenya, under Kenyan law.

9. Indemnification

You agree to indemnify and hold harmless SunSpear Safaris, its directors, employees, and agents from any claims, damages, or expenses arising from your breach of these terms or negligent acts.

10. Severability

If any provision of these terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

11. Changes to Terms

We may modify these terms at any time. Changes take effect when posted on the website. Continued use of our services constitutes acceptance of modified terms.
